Frequently Asked Questions

Do I need to hire an attorney for a slip and fall accident?

Not hiring an experienced slip and fall lawyer with a proven track record can cost you dearly.

Insurance companies often don’t take slip and fall claims that are personally submitted by the victim seriously. In addition, proving that the other party was negligent and negotiating with a trained insurance company adjuster can be very difficult.

These adjusters look after the interests of the insurance company, not yours. Their goal is to pay out as little as possible if anything. You need an attorney on your side who can look after YOUR best interests.

Trying to take on a defense attorney or an insurance company by yourself is not a smart move.

What damages can I claim for a slip and fall accident?

Depending on your case and unique circumstances, you may be able to recover compensation for the following:

  • Emergency medical expenses.
  • Future medical expenses you have to incur as a result of your accident.
  • Rehabilitation costs.
  • Pain and suffering.
  • Required therapy.
  • Necessary medication and medical devices.
  • Lost wages, including future loss of earnings.

The above is not an exhaustive list. Your slip and fall attorney will be able to advise what you can and should claim for based on your case.

Do I have to prove the other party was negligent?

The short answer is YES. To be compensated for a slip and fall accident you have to prove that the other party was negligent. You should also show that you acted reasonably and didn’t break any rules or behaved recklessly.

It may seem straightforward but it’s not always easy to prove.

For example, let’s assume you slipped on a liquid that was spilled on the floor of a store, fell, and injured yourself. You could argue that the store should have foreseen that someone could slip on it and should have cleaned it up. The store could argue that the spillage was visible, had just happened and that they didn’t have an opportunity to clean it up in time.

This is where an experienced slip and fall lawyer can be invaluable as they know what questions to ask and what to look for.

What to do after a slip and fall accident in a store

The first thing you should do is to seek medical attention. If you’re able to, you should also do the following or ask someone to help you:

  • Notify the store owner or manager about what happened.
  • Take photos or a video clip of the area where you fell and what you slipped on or tripped over.
  • If anyone witnessed your fall, try to obtain their contact information.
  • Check to see if there are cameras that could have recorded your fall and take photos of them.
  • Some stores will ask you to fill out an accident report. Do it while the details of what happened are still fresh in your head. Even if you’re not asked to fill out a report, make notes of what happened for your benefit.
  • Take photos of the clothes and shoes you’re wearing.

Don’t discuss your fall with a representative of the store’s insurance company or post about it on social media. Your answers to misleading questions can damage your case. Call a reputable slip and fall law firm such as Cohen & Marzban as soon as you can.
