California Vehicle Code Section 27803 specifies that you and your passenger have to wear a safety helmet while riding a motorcycle. That doesn’t mean you can’t claim damages for injuries sustained in a motorcycle accident caused by the negligence of another.

Can I sue the city of Los Angeles for a road defect?

Does it matter if I was riding on the dotted line between two lanes?

Many motorcycles drive between lanes when cars are not moving or are moving very slowly. This is called “lane splitting” and it’s legal in the State of California. There are a couple of exceptions though. Lane splitting isn’t allowed at high speeds or under unsafe conditions.
