What is elder abuse?

Chapter 1, Article 4, Section 21212(a) of the California Legislative Information Vehicle Code Section deals with helmets.
Section 21212(a) states that a person under the age of 18 years shall not operate a bicycle nor ride on a bicycle in a public space as a passenger unless that person is wearing a properly fitted and fastened bicycle helmet.

The helmet has to meet the standards of either the American Society for Testing and Materials (ASTM) or the United States Consumer Product Safety Commission (CPSC), or standards subsequently established by those entities.

The above requirement also applies to a person who rides on a bicycle while in a restraining seat that is attached to the bicycle or in a trailer towed by the bicycle.

What are signs of elder abuse?

The National Institute on Aging identifies the following signs of elder abuse.

The person:

  • Stops taking part in activities he or she enjoys.
  • Looks messy, with unwashed hair or dirty clothes.
  • Has trouble sleeping.
  • Loses weight for no reason.
  • Becomes withdrawn or acts agitated or violent.
  • Displays signs of trauma, like rocking back and forth.
  • Has unexplained bruises, burns, cuts, or scars.
  • Has broken eyeglasses / frames, or physical signs of punishment or being restrained.
  • Develops bed sores or other preventable conditions.
  • Lacks medical aids (glasses, walker, dentures, hearing aid, medications).
  • Has an eviction notice for unpaid rent, notice of late mortgage, or home eviction.
  • Has hazardous, unsafe, or unclean living conditions.
  • Displays signs of insufficient care or unpaid bills despite adequate financial resources.

Note: Be aware that the person may suffer abuse at the hands of another resident and not necessarily from the staff of the nursing home or assisted living facility.

How old is an “elder” under California law?

Under California Penal Code Section 368 an “elder” is a person who is 65 years of age or older.

What remedies are there for elders in California?
